General terms and conditions of Foliencenter GmbH for orders and enquiries placed via folie.ch.
1. Scope
1.1 These terms and conditions apply to all orders placed via the folie.ch online shop and to quotes and orders for vehicle lettering requested via folie.ch. The provider and contracting party is Foliencenter GmbH, Gewerbehallenstrasse 4, 8304 Wallisellen, Switzerland, UID CHE-228.099.207 (hereinafter “we” or “us”). Customers are hereinafter referred to as “the Customer”.
1.2 The range includes in particular printed textiles, signs (for example Alu-Dibond, acrylic glass, PVC, PVC banners, magnetic signs), stickers, cut vinyl lettering, wall decals, stamps and vehicle lettering. All products are made individually to the Customer’s specifications.
1.3 The version published on this page at the time of the order or of acceptance of the quote shall prevail. Any conflicting terms of the Customer apply only if we have agreed to them in writing. For vehicle lettering, any deviating details in our written quote take precedence over these terms and conditions.
2. Offer and conclusion of contract
2.1 The presentation of products on the website and in the designer does not constitute a binding offer but an invitation to order.
2.2 Shop orders: by submitting the order, the Customer makes a binding offer. The automatic confirmation e-mail merely documents receipt of the order. The contract is concluded when we accept the order, at the latest when production begins.
2.3 Vehicle lettering: the price shown in the designer is a non-binding guide price. Submitting an enquiry does not yet create a contract. We check the design, the data and the vehicle and send the Customer a written quote. The contract is only concluded when the Customer accepts the quote in writing (including by e-mail).
2.4 We may refuse an order or enquiry without giving reasons, in particular in the cases set out in section 10. In that case we will refund any amounts already paid in full.
3. Design, preview and approval
3.1 The Customer designs their products themselves in the online designer or supplies their own print data. Before submitting, they carefully check the design, texts (in particular spelling, telephone numbers and addresses), colours, dimensions, format, material, options and quantities in the preview.
3.2 By submitting the order, the Customer approves their design for production. The design as it appears in the preview or in the saved print data shall prevail. We are not obliged to check content for typing errors, meaning or suitability.
3.3 We may make minor technical adjustments to designs where this is necessary for flawless production and the overall impression is preserved (for example minimum line widths for plotted cut vinyl, cut contours and bleed for stickers, positioning within the print area). If more substantial changes are needed or the data are unsuitable for production (for example image resolution too low, multicoloured motifs for cut vinyl), we will contact the Customer before production.
3.4 For vehicle lettering, the Customer receives a design draft on their vehicle for approval before production. By approving it, they confirm the design, texts and placement.
3.5 If the Customer transfers a motif to another product in the designer (“Change product”), they check the design separately for each product.
4. Prices
4.1 All prices are in Swiss francs (CHF) including 8.1 % VAT, plus any shipping costs (section 7).
4.2 The price of a product depends on the product, format, material, options and quantity and is shown in the designer before the order is placed. For stickers, vinyl lettering and wall decals, a minimum order value per motif applies, which is shown in the designer.
4.3 For textiles, printing on the back costs an additional CHF 10 per item. A volume discount applies per motif: from 10 items 10 %, from 25 items 15 %, from 50 items 20 %. All textiles with the same motif are counted. For all other products, the tiered prices shown in the designer apply.
4.4 The price shown at the time of the order shall prevail; for vehicle lettering, the price stated in the accepted quote. Obvious pricing, typing and calculation errors are excepted.
5. Payment
5.1 For shop orders, the Customer can choose between:
- Card, Apple Pay or Google Pay via SumUp: payment is made when ordering, on the SumUp payment page.
- Invoice with QR code (payment in advance): the Customer receives an invoice with a QR code. Production only begins once payment has been received.
5.2 If payment of an advance-payment invoice has not been received within a reasonable period, we may cancel the order after giving prior notice.
5.3 Vehicle lettering is to be paid in accordance with the payment terms of the quote. We may request a deposit.
6. Production and delivery times
6.1 After the order is placed, we make the products individually in our workshop in Wallisellen (textile printing, digital printing, cutting plotter, stamp making). For individual work steps or large runs, we may involve partner companies.
6.2 Production usually takes place within a few working days of receipt of payment. Information on delivery times is a non-binding guide, unless we have expressly guaranteed a date in writing.
6.3 If a delivery is significantly delayed, we will inform the Customer. If a specific date is important (for example for an event or an opening), we ask the Customer to contact us before ordering.
7. Shipping and collection
7.1 We deliver by Swiss Post to addresses in Switzerland. Deliveries abroad are not possible via the shop. Shipping costs CHF 9.90 and is free for orders of CHF 70 or more.
7.2 Very large or bulky products can, after consultation, only be offered for collection or with a separate delivery at extra cost.
7.3 The order can be collected free of charge from us in Wallisellen, once we have notified the Customer and after arranging a time by telephone.
7.4 Benefit and risk pass to the Customer when the goods are handed over to Swiss Post or, in the case of collection, when they are handed over in Wallisellen.
7.5 The Customer is asked to report visibly damaged consignments to Swiss Post immediately upon delivery, and to us within the period set out in section 12.
8. Vehicle lettering and fitting
8.1 Fitting takes place in our workshop in Wallisellen on a mutually agreed date. The Customer brings the vehicle thoroughly washed, dry and without a fresh layer of wax or polish. If the vehicle is not ready for fitting, we may postpone the appointment and charge for the additional work.
8.2 The vehicle illustrations in the designer are based on scale drawings of the base model. Equipment variants (for example windows, doors, wheelbase, roof height, add-on parts) may differ. We check the vehicle before production and, if necessary, adjust the design in consultation with the Customer.
8.3 Films only adhere to an intact, clean and fully cured surface. On resprayed, damaged or weathered surfaces and on plastic parts with a textured surface, we give no warranty for adhesion and durability. Any pre-existing damage to the vehicle is recorded at handover.
8.4 High-quality vehicle films can usually be removed from intact original paintwork without leaving residue. We accept no liability for paint damage during later removal, in particular on resprayed or previously damaged surfaces.
8.5 The Customer is responsible for ensuring that the lettering complies with the regulations applicable to their vehicle (for example road traffic law, requirements of the leasing company or insurer).
8.6 If the Customer cancels an agreed fitting appointment less than two working days in advance, we may charge for material already produced and work already carried out.
9. No right of return or withdrawal
9.1 Swiss law does not provide a general right of withdrawal for online purchases. In addition, all products are made individually to the Customer’s specifications. Exchange, return and cancellation are therefore excluded as soon as production has begun. Under EU law, too, there is no right of withdrawal for goods made to the customer’s specifications.
9.2 If the Customer wishes to change or cancel an order before production begins, they are asked to contact us immediately at info@folie.ch. We will try to make this possible; however, there is no entitlement to it.
9.3 The Customer is responsible for choosing the correct products, sizes, dimensions, materials, colours and quantities. A wrongly chosen size or dimension does not constitute a defect.
10. Content and rights to motifs
10.1 The Customer is solely responsible for the images, logos, texts and other content they upload or create. By placing the order or enquiry, they confirm that they hold all necessary rights to it and that the manufacture and use of the products do not infringe any third-party rights, in particular copyright, trade mark, design, name or personality rights. This applies especially to third-party logos, club and company emblems, photos of people and official signs and coats of arms.
10.2 We do not systematically check content. If third parties bring claims against us because of a motif supplied by the Customer, the Customer shall indemnify us against these claims and bear the reasonable costs of legal defence.
10.3 We refuse or cancel orders if content is or could be unlawful, in particular where it infringes third-party rights, for stamps or signs that could be misleading as to identity or authority (for example imitated official or company stamps), and for racist, discriminatory, violence-glorifying, pornographic or otherwise offensive content. We refund any amounts already paid; the Customer has no further claims.
10.4 The Customer permits us to use and edit their motifs for processing the order (for example size, background removal, vectorisation, prepress) and, where necessary, to pass them on to partner companies involved. We use customer motifs and lettered vehicles for advertising purposes (for example reference images) only with the Customer’s consent.
10.5 Fonts, graphics, slogans and templates from the designer may only be used for the products ordered from us.
11. Quality, colours and tolerances
11.1 Colours on screen may differ from the finished product, depending on the screen, material, surface (for example textile colour, glass, wall, paintwork) and production process. Minor deviations in shade, size and position as well as the usual dimensional tolerances of materials and textiles do not constitute a defect. An exact shade (for example to RAL or Pantone) is only binding if we have confirmed it in writing.
11.2 The quality of the result depends on the quality of the files supplied. With low-resolution images, the print may appear blurred or pixelated; we give no warranty for this.
11.3 Information on durability (for example “outdoors up to 5 years” for films) is a guide value for the material when professionally applied and under normal conditions of use in Central Europe. It does not constitute a guarantee.
11.4 For products that the Customer mounts or applies themselves (for example stickers, vinyl lettering, wall decals, signs), we give no warranty for mounting errors, unsuitable surfaces (for example freshly painted, textured, damp or dusty surfaces) or damage to the surface on removal. Magnetic signs are only suitable for smooth, magnetic steel surfaces and must be removed before car washes, during longer periods of non-use and at high speeds, or checked regularly.
11.5 The care instructions must be followed to ensure the durability of textile prints.
12. Defects and complaints
12.1 The Customer inspects the goods immediately upon receipt, or the vehicle lettering at handover. They report defects in writing within 7 days of receipt to info@folie.ch, stating the order number and enclosing photos of the defect. Recognisable defects reported later are deemed to have been accepted.
12.2 In the case of a justified complaint, we will, at our discretion, remake the products concerned, rectify them or issue a credit note. Further warranty claims are excluded to the extent permitted by law.
12.3 On request, goods subject to a complaint must be returned or kept available for collection.
13. Liability
13.1 We are only liable for damage caused intentionally or through gross negligence. Liability for slight negligence, for indirect and consequential damage and for loss of profit is excluded to the extent permitted by law.
13.2 Mandatory statutory liability, in particular under the Swiss Product Liability Act and for personal injury, remains reserved.
13.3 We are not liable for delays and failures caused by force majeure or by disruptions at suppliers, partner companies or Swiss Post for which we are not responsible.
14. Data protection
How we process personal data is set out in our privacy policy.
15. Changes to these terms and conditions
We may change these terms and conditions at any time. An order is governed by the version published when the order was submitted; vehicle lettering by the version published when the quote was accepted.
16. Applicable law and place of jurisdiction
16.1 Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention).
16.2 The place of jurisdiction is Wallisellen, the registered office of Foliencenter GmbH. Mandatory statutory places of jurisdiction remain reserved, in particular that of consumers at their place of residence.
16.3 Should any provision of these terms and conditions be invalid, the remaining provisions shall remain valid.
